The battle between Toni Mphephu and others vs clementine Masindi Mphephu and others, regents who are of rightful heirs to take on the throne, however all seem to have taken a wrong turn for the acting king of Vhavenda, as he has been stripped of all the powers as king.
According to the judgment handed down by the constitutional court Friday 24 November 2021, regarding the application for leave to appeal against judgment and order of the Supreme Court of appeal which took place at Limpopo division of the high court in Thohoyandou striping the acting king off his role.
This came about after the first applicant Toni, ascended the throne in August 2010 where he was recognized by the President of South Africa Jacob Zuma, then the second applicant took the President along with Toni to court, claiming to be the rightful heir and to be given the Vhavenda throne.
The SCA believed that the ruling to state Toni as the rightful king, promotes ‘gender discrimination and that the ruling was illegal and unconstitutional.
Throughout all the drama of the throne battle, the royal council said it will no longer approach the court on the matter where they end up setting aside the SCA’s decision. Even they have accepted the decision stated by the court. It is still not known as to whether who will be the next regent for the Vhavenda nation.
